Bill: Work From Home Prioritization Act

Section 1: Short Title

This bill shall be known as the "Work from Home Prioritization Act."


Section 2: Findings

The Congress finds that:


1. Commuting to and from work is a significant source of traffic congestion, air pollution and GHG emissions, and is detrimental to citizens' well-being and health.

2. Remote work has become a viable option for many workers in the digital age, and can bring various benefits to employees, families, and communities, such as reducing stress, increasing productivity, and improving work-life balance.

3. The private sector and the federal government should promote work-from-home opportunities where appropriate, while ensuring that job quality, flexibility, and access to technology are guaranteed.


Section 3: Purpose

The purpose of this bill is to prioritize work from home as a means to reduce traffic congestion, improve employees' well-being and work-life balance, and mitigate climate change.


Section 4: Definitions

As used in this Act:

1. "Work from home" means work that is conducted fully or partially at a location other than the employer's physical workplace. This may include working remotely or telecommuting, using digital tools and telecommunications.

2. "Employer" means any individual or entity that hires one or more employees, and may include private or public organizations, corporations, partnerships, nonprofit entities, or the government at any level.

3. "Employee" means any individual who provides services to an employer, whether for compensation or not, and may include part-time or full-time workers, contractors, or freelancers.

4. "Traffic congestion" means the condition where the volume of vehicles on a given road, street, or highway exceeds its capacity, causing delays, accidents, or pollution.

5. "Greenhouse gas emissions (GHG)" means the release of carbon dioxide, methane, or other gases into the atmosphere that contribute to the warming of the Earth's climate.


Section 5: Work from Home Prioritization

1. Employers shall have a duty to prioritize telecommuting and flexible work arrangements whenever feasible, and to make good faith efforts to provide employees with the necessary tools, equipment, and training to work from home.

2. Employers shall be encouraged to adopt teleworking policies for eligible employees, and to develop and implement plans that facilitate work from home during times of high traffic volumes, special events, or other occasions that may require reducing commuting trips.

3. The federal government shall encourage the development of telecommuting infrastructure and technology, and provide financial and technical assistance to support small businesses and startups that promote remote work opportunities.

4. Federal agencies shall establish telecommuting policies and programs for their employees, where appropriate, and shall regularly assess and report on the effectiveness of such policies in reducing traffic congestion, promoting work-life balance, and reducing GHG emissions.

5. The Department of Transportation, in coordination with the Environmental Protection Agency and the Department of Labor, shall conduct a study on the feasibility and benefits of promoting telecommuting and flexible work arrangements as a means to reduce traffic congestion and GHG emissions, and shall report the findings to the Congress within one year of the enactment of this Act.


Section 6: Enforcement

1. Employers that fail to comply with the provisions of this Act may be subject to corrective action, fines, or penalties imposed by federal or state authorities.

2. Employees who feel that their rights under this Act have been violated may file complaints with their employer or with the Department of Labor, which shall investigate and report on such complaints.

3. Nothing in this Act shall be construed to limit or supersede any right or protection provided under any other federal or state law, regulation, or collective bargaining agreement.


Section 7: Funding

There is authorized to be appropriated such sums as may be necessary to carry out the provisions of this Act.


Section 8: Implementation

This Act shall be effective on the date of its enactment, and federal agencies shall have 180 days from the date of enactment to develop and implement policies and guidance to carry out the provisions of this Act.
