An Act to Preserve and Restore Wetlands and Regulate Pesticides


Purpose:


The purpose of this bill is to protect and restore important wetland ecosystems by regulating the use of pesticides, which have been shown to have detrimental effects on the health and stability of wetland ecosystems.


Section 1: Preserving Wetlands


a) Definition: For the purposes of this bill, a wetland is any area of land that is saturated with water for a significant portion of the year, and that supports a unique and diverse range of plant and animal life.


b) Protection: It shall be the policy of this state to protect and preserve wetlands from destruction, degradation, and loss.


c) Prohibitions: No person shall engage in any activity that would significantly degrade, alter, or destroy any wetland, unless such activity is essential to the health and safety of human populations.


Section 2: Restoring Wetlands


a) Restoration: The state shall undertake efforts to restore wetlands that have been damaged or degraded, using best available technology and scientific knowledge.


b) Funding: The state shall allocate sufficient funding for the restoration of wetlands, including grants and subsidies to private landowners for the restoration of wetland habitats.


Section 3: Regulation of Pesticides


a) Definitions: For the purposes of this bill, "pesticides" are defined as any chemical, biological or physical agent used to control, prevent or eliminate any unwanted organisms on or in any ecosystem.


b) Licensing: All pesticide applicators shall be licensed by the state and shall receive training in the proper use of pesticides, including the risks associated with their use.


c) Notification: Pesticide applicators shall provide notice to the public prior to the application of any pesticide, including the type of pesticide and the locations where it will be used.


d) Restrictions: The state shall prohibit the use of pesticides in or near wetland ecosystems, except as necessary to preserve human health and safety.


Section 4: Enforcement


a) Penalties: Any person or entity found in violation of the provisions of this bill shall be subject to fines, suspension or revocation of licenses or permits, and other appropriate penalties.


b) Jurisdiction: The state shall have jurisdiction to enforce this bill and any rules or regulations promulgated pursuant to this bill.


c) Citizen Suits: Any person, including private citizens and environmental organizations, may bring a civil action in a court of competent jurisdiction to enforce the provisions of this bill and to seek damages for any injury to wetlands caused by the use of pesticides.


Section 5: Severability


If any provision of this bill, or the application thereof to any person or circumstance, is held invalid, the remainder of the bill, and the application of such provision to other persons or circumstances, shall not be affected thereby.


Section 6: Effective Date


This bill shall take effect on July 1, 2025
