Bill Title: Committee Member Protection Act


Purpose: To protect the independence and integrity of committees and prevent state governors from removing committee members without just cause.


Section 1: Definitions


(a) For the purposes of this act, "committee" refers to any formally constituted body established by law or executive order to provide advice, oversight, or implementation of a specific policy or program.


(b) "Just cause" means that the committee member has violated ethical standards, demonstrated incompetence, or engaged in behavior that is detrimental to the committee's mission or the public interest.


Section 2: Prohibition on Removal of Committee Members


(a) The state governor shall not have the power to remove any committee member from their position unless there is just cause for such action.


(b) The state governor shall provide written notice to the committee member detailing the reasons for their removal and an opportunity to respond to those allegations.


(c) If the committee member disputes the governor's charges, the governor shall provide an opportunity for a hearing before an independent adjudicator.


(d) The governor's removal of a committee member shall not be effective until the independent adjudicator issues a decision on the matter.


Section 3: Committee Member Protection


(a) Committee members shall be protected from retaliation or discrimination for performing their duties or speaking out on issues related to the committee's mission or the public interest.


(b) Any committee member who believes they have been subject to retaliation or discrimination may bring a complaint before an independent adjudicator.


(c) If the independent adjudicator determines that retaliation or discrimination has occurred, they shall order appropriate relief, including reinstatement, back pay, or damages.


Section 4: Enforcement


(a) The Attorney General for each state shall enforce the provisions of this act.


(b) Any person who violates the provisions of this act shall be subject to civil fines and penalties.


Section 5: Effective Date


This act shall take effect immediately upon passage.
