AN ACT TO ADDRESS RISING SEA LEVELS AND CLIMATE CHANGE IN THE STATE OF FLORIDA
SECTION 1. SHORT TITLE
This Act shall be known and may be cited as the “Florida Climate Change and Sea Level Rise Protection Act.”
SECTION 2. FINDINGS AND PURPOSE
The Florida Legislature hereby finds that:
1. The scientific community unequivocally agrees that climate change is real and presents a serious threat to Florida;
2. Florida is particularly vulnerable to climate change impacts such as sea level rise, coastal erosion, and flooding due to its low-lying geography, flat terrain, and porous bedrock;
3. These impacts are already being felt in many parts of Florida, and they are projected to worsen over time, putting Florida’s communities, ecosystems, and economy at risk;
4. There is an urgent need for the State of Florida to take action to reduce greenhouse gas emissions, adapt to climate change impacts, and protect its residents and infrastructure from the known and anticipated effects of these impacts.
The purpose of this Act is to address the threat of climate change and rising sea levels by establishing statewide goals, measures, and strategies for reducing greenhouse gas emissions and adapting to the impacts of climate change.
SECTION 3. DEFINITIONS
As used in this Act, unless the context requires otherwise:
1. “Adaptation” means the process of adjusting to actual or expected climate change impacts.
2. “Climate change” means a change in the long-term patterns of average weather conditions that have come to define Earth's local, regional, and global climates.
3. “Greenhouse gas” means any gas that traps heat in the atmosphere and contributes to the greenhouse effect, including carbon dioxide, methane, nitrous oxide, and fluorinated gases.
4. “Greenhouse gas emissions” means the release of greenhouse gases into the atmosphere from human activities, such as the burning of fossil fuels, deforestation, and industrial processes.
5. “Mitigation” means the process of reducing or eliminating greenhouse gas emissions to mitigate the extent and impact of climate change.
6. “Plan” means the statewide plan required in this Act.
7. “Resilience” means the capacity of a system or community to absorb and recover from the impacts of climate change.
8. “Sea level rise” means the gradual increase in the average level of the ocean as a result of the melting of ice sheets and glaciers, and the thermal expansion of seawater.
SECTION 4. STATEWIDE GOALS
1. Greenhouse Gas Emissions Reduction: The State of Florida shall reduce its greenhouse gas emissions by at least 50% below 2005 levels by 2026, and achieve net-zero emissions by 2038.
2. Adaptation and Resilience: The State of Florida shall develop and implement adaptation and resilience measures to address the impacts of climate change, including sea level rise, coastal erosion, and flooding.
SECTION 5. STATEWIDE PLAN
1. The State of Florida shall develop a comprehensive statewide plan to achieve the greenhouse gas emissions reduction and adaptation and resilience goals set forth in Section 4.
2. The plan shall:
(a) Establish interim emissions reduction targets for every year between 2025 and 2038;
(b) Identify specific measures to achieve the emissions reduction targets, including measures to reduce emissions from the transportation, electricity, industrial, and commercial sectors, as well as measures to promote the use of renewable energy and energy efficiency;
(c) Identify specific adaptation and resilience measures to protect vulnerable communities, ecosystems, and infrastructure from the impacts of climate change, including sea level rise, coastal erosion, and flooding;
(d) Assess the potential economic, social, and environmental impacts of climate change on the State of Florida, and identify strategies to minimize, manage, and adapt to these impacts;
(e) Engage with stakeholders, including local governments, businesses, environmental organizations, and other interested parties, to solicit their input and feedback on the plan and its implementation;
(f) Include a monitoring and reporting system to track progress toward achieving the emissions reduction and adaptation and resilience goals, and to provide regular updates to the public on these efforts.
SECTION 6. IMPLEMENTATION
1. The State of Florida shall establish a Climate Change and Sea Level Rise Task Force to oversee the development and implementation of the statewide plan.
2. The Task Force shall be composed of representatives from state agencies, local governments, businesses, environmental organizations, and other stakeholders, and shall meet at least four times per year.
3. The Task Force shall:
(a) Provide guidance and oversight to state agencies responsible for implementing the statewide plan;
(b) Review and approve interim emissions reduction targets and measures;
(c) Monitor the progress of the plan’s implementation, and provide regular updates to the public;
(d) Recommend legislative and policy changes to advance the goals of this Act.
4. The Governor shall appoint the members of the Task Force within 30 days of the effective date of this Act.
SECTION 7. FUNDING
1. The State of Florida shall establish a dedicated funding source to support the implementation of the statewide plan.
2. The funding source may include:
(a) State general revenue funds;
(b) Fees or taxes on greenhouse gas emissions, fossil fuel extraction, or other activities that contribute to climate change;
(c) Federal funding, grants, or other assistance for climate change mitigation and adaptation programs.
SECTION 8. SEVERABILITY
If any provision of this Act or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of this Act which can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 9. EFFECTIVE DATE
This Act shall take effect immediately upon approval by the Governor.
