Homeless Protection Act
Purpose: To ensure that homeless individuals are not harassed, abused or unfairly targeted by law enforcement and to provide necessary assistance to the homeless population.
Section 1: Definitions
a. Homeless individual - Any person who is without a permanent dwelling, including persons who are living on the streets, in a shelter, or in a vehicle.
b. Harassment - Any act or behavior that is intended to cause alarm, distress, or fear to a homeless individual.
c. Unfair targeting - The act of singling out homeless individuals for scrutiny or enforcement actions on the basis of their housing status.
Section 2: Police Conduct
a. Police officers may not harass, abuse or unfairly target homeless individuals.
b. Police officers may not take any enforcement action for sleeping, sitting, or lying down in a public place unless the activity creates a substantial and direct threat to public safety or impedes the use of public property.
c. Police officers must follow due process before enforcing any ordinances or laws prohibiting or regulating sleeping, sitting, or lying down in public places.
d. Police officers may not confiscate or destroy personal property belonging to homeless individuals unless it is necessary for public safety or is an item that poses an immediate threat to public health.
Section 3: Access to Services
a. Homeless individuals have the right to access public services without discrimination.
b. Public facilities must provide access to restrooms and drinking water for all individuals, regardless of housing status.
c. Any health or social service facilities must prioritize homeless individuals in appointment scheduling.
d. Any public transportation system must provide clear information on services available to homeless individuals, including free or reduced-fare transportation to essential services.
Section 4: Penalties and Enforcement
a. Any violation of this act may result in a civil penalty, to be determined by a judge.
b. Law enforcement agencies that violate the provisions of this act may be subject to disciplinary measures.
c. Any individual may bring a civil action against any law enforcement agency or officer found to be in violation of this act.
Section 5: Implementation
a. This act shall be implemented within 60 days of its passage.
b. The Department of Health and Human Services shall be responsible for implementing this act and ensuring that its provisions are effectively communicating to law enforcement agencies across the state.
Section 6: Funding
a. The funds necessary to carry out the provisions of this act shall be appropriated by the state legislature and allocated to the Department of Health and Human Services.
b. Local governments may also provide additional funding to support homeless services and community outreach programs.
Section 7: Severability
a. If any provision of this act is found to be unconstitutional or invalid, such provision shall be severed from the act, and the remaining provisions shall remain valid and enforceable.
Section 8: Effective Date
a. This act shall take effect immediately upon passage.
