Bill: Lake County Performing Arts Center Act

BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF LAKE COUNTY, FLORIDA:


SECTION 1. SHORT TITLE.

This act shall be known and may be cited as the "Lake County Performing Arts Center Act."


SECTION 2. FINDINGS AND PURPOSE.

The Legislature finds that Lake County is in need of a new performing arts center to enhance cultural opportunities and economic growth. The Legislature intends to provide funding and authorization to construct a state-of-the-art facility to promote the arts and benefit the citizens of Lake County.


SECTION 3. DEFINITIONS.

For purposes of this act, the following terms have the following meanings:

(1) "Performing Arts Center" means a facility designed for live performances, including musical productions, plays, dance performances, and other forms of artistic expression.

(2) "Lake County" means the geographic area that includes all of the cities and unincorporated areas of Lake County, Florida.


SECTION 4. CONSTRUCTION OF LAKE COUNTY PERFORMING ARTS CENTER.

(a) Authorization for Construction. The Lake County Board of County Commissioners is hereby authorized to contract for the construction of a performing arts center in Lake County, Florida.

(b) Funding for the Performing Arts Center. The Legislature shall appropriate funds to the Lake County Board of County Commissioners for the construction of the performing arts center.

(c) Design and Location of the Performing Arts Center. The Lake County Board of County Commissioners shall be responsible for the design and location of the performing arts center. The location shall be in a central and accessible location for the residents of Lake County.

(d) Cost Controls. The Lake County Board of County Commissioners shall ensure that the performing arts center is constructed within a reasonable budget and with competitive bids for all contractors.


SECTION 5. OPERATION OF THE PERFORMING ARTS CENTER.

(a) Management. The Lake County Board of County Commissioners shall contract with a qualified management company to operate the performing arts center.

(b) Use of the Performing Arts Center. The performing arts center shall be available for use by all residents and organizations within Lake County.

(c) Fees and Charges. The Lake County Board of County Commissioners shall establish reasonable fees and charges for the use of the performing arts center.


SECTION 6. EFFECTIVE DATE.

This act shall become effective immediately upon becoming law.


SECTION 7. APPROPRIATION.

There is hereby appropriated the sum of $20,000,000 from the general revenue fund to the Lake County Board of County Commissioners for the construction of the performing arts center authorized in this act.


SECTION 8. SEVERABILITY.

If any provision of this act or the application thereof to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.
