Fish Population Restoration Act


Purpose: To restore and enhance fish populations in suitable ponds and increase aquatic biodiversity.


Whereas, fish populations in natural ponds have been greatly reduced due to overfishing, pollution, habitat destruction, and other factors, leading to a decline in aquatic biodiversity and related ecological problems, and


Whereas, the restoration of fish populations in suitable ponds can contribute to improving the ecological health, recreational and educational opportunities, and economic benefits of local communities, as well as supporting sustainable management of aquatic resources, and


Whereas, the introduction of fish populations to ponds should be based on sound scientific principles, ecological considerations, and consultation with local stakeholders,


Be it enacted by the Congress:


Section 1. Definitions


(a) Suitable ponds: Natural or artificial bodies of water that meet the criteria for supporting fish populations, including sufficient size, depth, water quality, habitat, and access.


(b) Native fish species: Fish that occur naturally in the area or historically inhabited the area before the introduction of non-native species.


(c) Non-native fish species: Fish that were introduced to the area from other regions or countries and can pose threats to native species, ecological processes, and human activities.


Section 2. Fish Population Restoration Program


(a) The Secretary of the Interior, in consultation with the U.S. Fish and Wildlife Service, state fish and wildlife agencies, and other relevant entities, shall establish and administer a Fish Population Restoration Program to identify and prioritize suitable ponds for fish population restoration, based on ecological, social, and economic factors.


(b) The Fish Population Restoration Program shall provide technical assistance, funding, and other resources to eligible projects that aim to introduce or enhance native fish populations in suitable ponds, while minimizing the adverse effects on non-native species, other wildlife, and habitat.


(c) The Fish Population Restoration Program shall prioritize projects that:


(i) Use native fish species that are locally adapted and compatible with the ecological conditions of the pond and the surrounding watershed;


(ii) Enhance the ecological functions of the pond and its connectivity to other aquatic habitats;


(iii) Involve local communities and stakeholders in the planning, implementation, and monitoring of the project, and promote public education and outreach on the values and benefits of fish populations and aquatic biodiversity.


Section 3. Non-Native Species Control


(a) The introduction or enhancement of non-native fish species in suitable ponds shall be allowed only if it is necessary for research or management purposes, and when adequate measures are taken to prevent their escape, establishment, or negative impacts on native species, ecosystems, or human activities.


(b) The Fish Population Restoration Program shall work with federal and state agencies, as well as private landowners and other entities, to monitor, control, and eradicate non-native fish populations in suitable ponds, especially when they pose threats to native species or ecological processes.


Section 4. Funding


(a) There shall be authorized to be appropriated $50 million annually for the Fish Population Restoration Program, to be allocated among eligible projects based on the criteria and priorities established in this Act.


(b) The Fish Population Restoration Program may also receive funds from other federal, state, local, and private sources, subject to the same criteria and priorities.


Section 5. Reporting and Evaluation


(a) The Secretary of the Interior shall submit an annual report to the Congress and the public on the implementation and outcomes of the Fish Population Restoration Program, including the number and type of projects funded, the amount and sources of funds received and expended, the ecological and social impacts of the projects, and the lessons learned and recommendations for future improvements.


(b) The Fish Population Restoration Program shall be subject to periodic evaluation by independent experts and stakeholders, to assess its effectiveness, efficiency, and compliance with the goals and standards of this Act.


Section 6. Severability


If any provision of this Act, or the application of such provision to any person or circumstance, is held to be invalid, the remainder of this Act, or the application of such provision to other persons or circumstances, shall not be affected thereby.


Section 7. Effective Date


This Act shall take effect on the date of its enactment.
